Medicine, like law, is a pragmatic, probabilistic activity. Both require that decisions be made on the basis of available evidence, within a limited time. In contrast to law, medicine, particularly evidence-based medicine as it is currently practiced, aspires to a scientific standard of proof, one that is more certain than the standards of proof courts apply in civil and criminal proceedings. But medicine, as Dr. William Osler put it, is an "art of probabilities," or at best, a "science of uncertainty." (...) One can better practice medicine by using other evidentiary standards in addition to the "scientific." To employ only the scientific standard of proof is inappropriate, if not impossible; furthermore, as this review will show, its application in medicine is fraught with bias. Evidence is information. It supports or undermines a proposition, whether a hypothesis in science, a diagnosis in medicine, or a fact or point in question in a legal investigation. In medicine, physicians marshal evidence to make decisions on how to best prevent, diagnose, and treat disease, and improve health. In law, courts decide the facts and render justice. Judges and juries assess evidence to establish liability, to settle custody and medical issues, and to determine a defendant's guilt or innocence. (shrink)

As a way to make medical decisions, Evidence-Based Medicine (EBM) has failed. EBM's failure arises from not being founded on real-world decision-making. EBM aspires to a scientific standard for the best way to treat a disease and determine its cause, but it fails to recognise that the scientific method is inapplicable to medical and other real-world decision-making. EBM also wrongly assumes that evidence can be marshaled and applied according to an hierarchy that is determined in an argument by authority to (...) the method by which it has been obtained. If EBM had valid theoretical, practical or empirical foundations, there would be no hierarchy of evidence. In all real-world decision-making, evidence stands or falls on its inherent reliability. This has to be and can only be assessed on a case-by-case basis applying understanding and wisdom against the background of all available facts—the "factual matrix." EBM's failure is structural and was inevitable from its inception. EBM confuses the inherent reliability and probative value of evidence with the means by which it is obtained. -/- EBM is therefore an ad hoc construct and is not a valid basis for medical decision-making. This is further demonstrated by its exclusion of relevant scientific and probative real-world decision-making evidence and processes. It draws upon a narrow evidence base that is itself inherently unreliable. It fails to take adequate account of the nature of causation, the full range of evidence relevant to its determination, and differing approaches to determining cause and effect in real-world decision-making. EBM also makes a muddled attempt to emulate the scientific method and it does not acknowledge the role of experience, understanding and wisdom in making medical decisions. (shrink)

Future-bias is the preference, all else being equal, for positive states of affairs to be located in the future not the past, and for negative states of affairs to be located in the past not the future. Three explanations for future-bias have been posited: the temporal metaphysics explanation, the practical irrelevance explanation, and the three mechanisms explanation. Understanding what explains future-bias is important not only for better understanding the phenomenon itself, but also because many philosophers think that which explanation is (...) the correct one has implications for our evaluation of the normative status of future-bias. In this paper we focus on the connection between future-bias and the temporal value asymmetry. The latter refers to the fact that people tend to assign more value to a state of affairs when it is located in the future, as opposed to being equidistant in the past. All three candidate explanations offered for future-bias proceed by explaining the temporal value asymmetry, and then supposing that future-bias is simply a manifestation of that asymmetry. Recently, however, it has been argued that the conditions under which people display the temporal value asymmetry and future-bias are different, and that this is reason to doubt that the latter is a manifestation of the former. In this paper we empirically test one response to this argument against the manifestation thesis—the simulation response—according to which once we control for the degree to which people can simulate the object of their preference, we find that people display future-bias and the temporal value asymmetry in the same conditions. We find no evidence in favour of the simulation response. Moreover, our results support some previous research that suggests that the temporal value asymmetry is less robust than previously thought, and this in itself casts doubt on the idea that future bias is just a manifestation of this asymmetry. Empirical evidence shows that people have multiple time-biases. One is near-bias, another is future-bias, and a third is present-bias. Philosophers are concerned with the normative status of these time-biases. They have argued that, at least in part, the normative status of these biases depends on the extent to which they tend to promote, or frustrate, wellbeing, where “wellbeing” is taken to be of fundamental value. Since near-bias is thought to be associated with impulsivity, lack of self-control, and poor long-term health (...) and financial outcomes, it has often been supposed that it is associated with lower wellbeing. On those grounds, philosophers have argued that near-bias is rationally impermissible. By contrast, philosophical views about the normative status of future-bias have been mixed, with some arguing that future-bias is impermissible because, they think, it frustrates wellbeing, and others arguing that it is at least permissible (and perhaps obligatory) because it is the product of mechanisms whose functioning can be expected to promote wellbeing. However, to date there are no studies that have directly probed how time-biases correlate with wellbeing. Since it's not a settled matter which psychological mechanisms underlie time-biases, it is not uncontroversial which things serve as proxies for these preferences. We directly empirically investigate the connection between time-biases and measures of wellbeing, to see which of these biases is associated with promoting, or frustrating wellbeing. Contrary to expectation, we found no evidence that near-bias or present-bias are associated with frustrating wellbeing on any of the constructs we measured. On the other hand, and contrary to what some philosophers have supposed, we found that future-bias was associated with higher measures of wellbeing on several measures. We consider the implications of these findings for the evaluation of the normative status of these time biases. (shrink)

Since its publication, the Psychopathic Personality Inventory and its revision (Lilien- feld & Andrews, 1996; Lilienfeld & Widows, 2005) have become increasingly popular such that it is now among the most frequently used self-report inventories for the assessment of psychopathy. The current meta-analysis examined the relations between the two PPI factors (factor 1: Fearless Dominance; factor 2: Self-Centered Impulsivity), as well as their relations with other validated measures of psychopathy, internalizing and externalizing forms of psychopathology, general personality traits, and antisocial (...) personality disorder symptoms. Across 61 samples reported in 49 publications, we found support for the convergent and criterion validity of both PPI factor 2 and the PPI total score. Much weaker validation was found for PPI factor 1, which manifested limited convergent validity and a pattern of correlations with central criterion variables that was inconsistent with many conceptualizations of psychopathy. Emile Benvcniste may be used to introduce the topic. The French linguist begins an essay on “Euphemisms Ancient and Modern” with a paradox about the early Greek definitions of euphemism. “To speak words which augur well” is one meaning given, but another is “to maintain silence”. This initial contradiction is further compounded by yet a third expression, “to shout in triumph”. The dilemma is. however, easily dissolved. To speak words which augur well implies, for special occasions, an exhortation even to (...) shout triumphantly, “to assent by an, auspicious outcry”: it further implies, again depending on the circumstances, “to avoid words which augur ill”, hence, if necessary, to say nothing. As one definition explains “avoid all unlucky words during sacred rites: hence, as the surest mode of avoiding them, keep a religious silence” (original emphasis). Paradox terminates; we are merely dealing with “a euphemism for a euphemism” taking an expression of Benveniste out of context. (shrink)

As we conceived of Interpretation, we had no interest in merely launching another journal; in providing another channel of literary expression; or in creating another public relations medium for the purpose of making Union Theological Seminary more widely known. No, we designed Interpretation to have a mission. Our aim was to create a medium through which the church would understand more fully its nature as the body of Christ giving expression to the will of its head.

ABSTRACT: Abstract Most modern knowledge is not science. The physical sciences have successfully validated theories to infer they can be used universally to predict in previously unexperienced circumstances. According to the conventional conception of science such inferences are falsified by a single irregular outcome. And verification is by the scientific method which requires strict regularity of outcome and establishes cause and effect. -/- Medicine, medical research and many “soft” sciences are concerned with individual people in complex heterogeneous populations. These populations (...) cannot be tested to demonstrate strict regularity of outcome in every individual. Neither randomised controlled trials nor observational studies in medicine are science in the conventional conception. Establishing and using medical and other “soft science” theories cannot be scientific. It requires conceptually different means: requiring expert judgement applying all available evidence in the relevant available factual matrix. -/- The practice of medicine is observational. Prediction of outcomes for the individual requires professional expertise applying available medical knowledge and evidence. Expertise in any profession can only be acquired through experience. Prior cases are the fundament of knowledge and expertise in medicine. Case histories, studies and series can provide knowledge of extremely high reliability applicable to establishing reliable general theories and falsifying others. Their collation, study and analysis should be a priority in medicine. Their devaluation as evidence, the failure to apply their lessons, the devaluation of expert professional judgement and the attempt to emulate the scientific method are all historic errors in the theory and practice of modern medicine. ABSTRACT Certain problems in commonsense reasoning lend themselves to the use of non-standard formalisms which we call active logics. Among these are problems of objects misidentification. In this paper we describe some technical issues connected with automated inference in active logics, using particular object misidentification problems as illustrations. Control of exponential growth of inferences is a key issue. To control this growth attention is paid to a limited version of an inference rule for negative introspection. The civic republican tradition in political thought includes Niccolo Machiavelli, Jean-Jacques Rousseau, and Alexis de Tocqueville. The belief that it is imperative that citizens participate actively and disinterestedly in public affairs, i.e., that they possess "civic virtue" or "public spirit" is a prominent family resemblance between its members. Civic republican thought has undergone a recent resurgence, and one consequence is that political philosophers and other theorists have begun to ask whether liberals can take civic virtue seriously. Certain critics of liberalism, (...) including Michael Sandel and Charles Taylor, have answered this question in the negative. They give a variety of reasons for this answer, ranging from the inability of the atomistic ontologies underlying many liberal theories to make sense of the existence of a common good to the inability of the liberal state to concern itself with the character of its citizens. ;For the most part, unsurprisingly, these antiliberals direct their arguments at the work of twentieth-century "deontological" liberals such as John Rawls and Ronald Dworkin. While Rawls and Dworkin say relatively little about civic virtue, many earlier liberals believed firmly in its importance. John Stuart Mill's centrality to the liberal tradition and the thoroughgoing nature of his liberalism make him an especially interesting "civic liberal." My central thesis is that the civic and liberal components of his political philosophy combine to form a coherent whole. In my early exegetical chapters I provide the first systematic exposition of the frequently ignored civic component. I then address the work of several of Mill's interpreters who either explicitly or implicitly point to possible problems with his attempt to weave together the civic and liberal strands in his thought, and conclude that these problems are either not real or not insoluble. Finally, I consider whether the arguments which Sandel and Taylor, et. al., have given to show that contemporary liberal theories cannot consistently incorporate the civic republican belief in the importance of active and disinterested civic participation might have force against Mill. I show that they do not, and not simply because On Liberty is not A Theory of Justice but because the many of the objections are poorly reasoned. (shrink)

Purpose This short viewpoint is a response to a lead paper on professional ethics in the information age. This paper aims to draw upon the authors’ experience of professional bodies such as the ACM over many years. Points of agreement and disagreement are highlighted with the aim of promoting wider debate. Design/methodology/approach An analysis of the lead paper is undertaken using a binary agree/disagree approach. This highlights the conflicting views which can then be considered in more detail. Findings Four major (...) agreements and four major disagreements are identified. There is an emphasis on “acultural” professionalism to promote moral behavior rather than amoral behavior. Originality/value This is an original viewpoint which draws from the authors’ practical experience and expertise. (shrink)

We examine the implications of the US government’s too-big-to-fail policy as it has been applied to banks. Using alternative measures of risk, we compare the risk-taking behavior of 11 TBTF banks, identified by the Comptroller of the Currency in 1984, to a number of non-TBTF banks. We provide both theory and new empirical evidence to support our argument that the TBTF policy leads management to significantly increase risk-taking, with no corresponding increase in performance. While prior studies have considered the effects (...) of the TBTF policy on limited, but risk-related aspects of bank behavior, such as the cost of funds, our study provides direct evidence about the risk-taking behavior associated with the TBTF policy. Our study has important implications for the current political debate regarding the too-big-to-fail policy. (shrink)

The Software Engineering Code of Ethics and Professional Practice, intended as a standard for teaching and practicing software engineering, documents the ethical and professional obligations of software engineers. The code should instruct practitioners about the standards society expects them to meet, about what their peers strive for, and about what to expect of one another. In addition, the code should also inform the public about the responsibilities that are important to the profession. Adopted in 2000 by the IEEE Computer Society (...) and the ACM--two leading international computing societies--the code of ethics is intended as a guide for members of the evolving software engineering profession. The code was developed by a multinational task force with additional input from other professionals from industry, government posts, military installations, and educational professions. (shrink)

This article is a comment on barry miller, "proper names and their distinctive senses," "australian journal of philosophy", Volume 52, Pages 201-210, January 1974. Miller claims that the sense of a name is its role of referring to the individual to which it has been attached in the act of naming. Miller also claims that names have unique senses and that it is impossible in principle to say what these senses are. Here it is shown that these (...) claims are incompatible. Miller's account of the senses of names also results in the problem which frege's distinction between sense and reference was intended to solve. (shrink)
